Do you know what constitutes an excused absence?

It is always important to remember that the relationship between employee and employer should be based on balance and reciprocity. When a worker begins their journey in a company, they not only acquire rights but also assume fundamental responsibilities for the proper functioning of this relationship. This balance is regulated by the Consolidation of Labor Laws (CLT), which seeks to ensure fairness and mutual protection in this bond.

Article 473 of the CLT (Consolidation of Labor Laws) is an excellent example of the guarantees granted to workers so that they can attend to personal and family situations without this causing a loss of salary. This article covers several situations in which the employee is entitled to paid leave, reflecting the sensitivity of Brazilian legislation in protecting workers during the most important moments of their lives.

Among the main hypotheses, we have:

  1. Death of family members: The employee is entitled to up to 2 consecutive days in the event of the death of a spouse, ascendants, descendants, siblings, or financial dependents.
  2. Marriage: The employee is entitled to 3 consecutive days of paid leave due to marriage, ensuring a period of celebration and adjustment to their new married life.
  3. Birth of a child or shared custody: The article guarantees the father 5 consecutive days of paternity leave, ensuring his participation in the first moments of the child's life or in the new family dynamic in cases of shared custody.
  4. Voluntary blood donation: To encourage this act of solidarity, the worker is entitled to 1 day of leave per year, duly documented.
  5. Voter registration: To fulfill their civic obligations, employees may be absent for up to 2 days (consecutive or not) to register to vote, in accordance with current electoral legislation.
  6. Fulfillment of military service requirements: The worker is also protected for the time necessary to fulfill the obligations imposed by military service.
  7. University entrance exams: The law guarantees the right to be absent from work on the days when the employee is taking university entrance exams for admission to a higher education institution.
  8. Court appearance: In situations where the worker needs to appear in court, the time off is guaranteed by the CLT (Brazilian Labor Law), so that the employee can exercise their rights without impacting their salary.
  9. International trade union meetings: Workers representing a trade union at official meetings of international organizations of which Brazil is a member are entitled to the necessary time off.
  10. Accompanying a spouse or partner to medical appointments during pregnancy: The employee may take time off to accompany their spouse or partner to up to 6 medical appointments during pregnancy.
  11. Accompanying a child to medical appointments: Workers are entitled to one day per year to accompany their child (up to 6 years old) to medical appointments, reinforcing the protection of childhood.

These rights reflect the legislator's commitment to creating conditions that allow workers to reconcile their professional lives with family and civic responsibilities, guaranteeing financial protection during these absences.

While the Brazilian Labor Code (CLT) grants a series of rights to the employee, it also imposes important obligations. These responsibilities are essential for the employment relationship to occur harmoniously and productively, both for the employee and the employer. By accepting an employment contract, the employee commits to following certain contractual and legal rules, such as:

  1. Punctuality and attendance: Adherence to established schedules is fundamental for work organization. Furthermore, absences must be justified, preferably in advance, ensuring that the company's workflow is not unnecessarily interrupted.
  2. Care for company assets: Employees must take care of the material resources entrusted to them, using them responsibly and efficiently. Improper use can result in damage that impacts both the company and the work environment itself.
  3. Following internal policies and procedures: Each company has its own code of conduct and safety standards. Compliance with these policies, such as the use of personal protective equipment (PPE) and respect for the confidentiality of strategic information, is crucial for the integrity of the work environment.
  4. Meeting goals and deadlines: The employee has an obligation to perform their duties diligently and with dedication, respecting established deadlines and goals. Failure to observe these parameters can harm not only the company but also the employee's professional development.
  5. Respect for hierarchy and positive relationships: Maintaining respect for hierarchical authority, as well as cultivating a healthy and collaborative work environment, is an obligation for all employees. Harmonious coexistence contributes to collective efficiency and the success of the company.
  6. Compliance with contractual and legal rules: The employment contract and labor laws establish limits and obligations that must be observed. Disregarding these rules can result in disciplinary sanctions, such as warnings, suspensions, and even dismissal for just cause.

Fulfilling these responsibilities strengthens the bond of trust between employer and employee, promotes a safer and more productive work environment, and consequently increases the chances of professional growth within the company.

Understanding one's rights and responsibilities in the workplace is a fundamental pillar for professional success. Brazilian labor law seeks to protect the worker while ensuring a fair relationship with the employer. By exercising their rights and fulfilling their obligations, employees contribute to building a balanced and harmonious work environment, essential for their growth and the development of the company.
